PUBLIC OFFER
On the Use of the Website and Making Charitable Donations

This document is an official public offer (hereinafter referred to as the “Offer”) of the Together with Kernel Charitable Foundation (hereinafter referred to as the “Foundation”), published on the website https://razom.kernel.ua (hereinafter referred to as the “Website”) and addressed to an indefinite number of individuals to regulate the use of the Website and the procedure for making charitable donations.
1. General Provisions
1.1. This Offer sets out the terms of use of the Website, access to its sections, and the procedure for making voluntary charitable donations.
1.2. Use of the Website or making a donation constitutes full and unconditional acceptance of the terms of this Offer.
1.3. If the user disagrees with the terms of this Offer, they must refrain from using the Website and/or making donations.
2. Subject of the Offer
2.1. The Foundation provides users with the ability to:
- Learn about the Foundation’s activities.
- View news, reports, projects, grant programs, and other materials.
- Contact the Foundation via the forms on the Website.
- Voluntarily make charitable donations to support the Foundation’s mission.
3. Intellectual Property Rights
3.1. All materials published on the Website, including texts, graphics, logos, videos, etc., are the property of the Foundation or used with legal permission.
3.2. Any copying or distribution of materials is permitted only with written consent from the Foundation or with proper attribution to the source.
4. Website Use
4.1. Users agree to use the Website for lawful purposes only and not to engage in activities that could harm the Foundation or third parties.
4.2. The following are strictly prohibited:
- Disruption of the Website’s security or functionality
- Uploading malicious code or phishing links
- Using the Website to distribute spam or collect data unlawfully
5. Charitable Donations
5.1. Users may voluntarily make a monetary charitable donation via the functionality provided on the Website.
5.2. Donations are unconditional and non-refundable and are provided to the Foundation for achieving the goals outlined in its Charter.
5.3. Completing a donation via the integrated payment system constitutes full acceptance (acceptance of the offer) of this Offer.
5.4. Funds are used to support programs, projects, aid delivery, procurement, logistics, communications, and other activities related to the Foundation’s charitable mission.
5.5. Financial reports on the use of funds are available publicly in the “Reports” section of the Website.
6. Liability
6.1. The Foundation is not liable for technical failures, Website unavailability, or data loss resulting from third-party actions or force majeure events.
6.2. The Foundation does not verify the identity of donors, except as required by applicable law.
7. Personal Data
7.1. By submitting any information via the Website, the user consents to the processing of their personal data in accordance with the Foundation’s Privacy Policy.
8. Final Provisions
8.1. This Offer is effective from the date of publication on the Website and remains valid indefinitely until revoked or updated.
8.2. The Foundation reserves the right to modify the terms of this Offer. The most current version is always available on the Website.
8.3. The laws of Ukraine shall govern all legal relations arising under this Offer.
